In conjunction with the announcement of the increase in the small claims track limit and the launch of the Official Injury Claims service on 31 May 2021, the Ministry of Justice have announced some changes to the RTA Pre-Action Protocol. To reflect these changes in Claims Portal workflows, it will be necessary to make some amendments within the Claims Portal. Although we have kept the changes to the minimum we regard as essential, development will be necessary which will result in changes to both the web portal and A2A. This will be achieved via a suite of changes that will be implemented through a Release on the service. The A2A community will be required to undertake their own development and testing to deliver changes on their own systems before the end of May.

A high-level summary of the changes includes:

1) Re-labelling the injury fields in Section B of the CNF to ensure that claims including tariff damages can be identified;

2) New fields in the Interim Settlement Pack to record separately tariff damages and non-tariff PSLA;

3) New fields in the Stage 2 Settlement Pack to enable the claimant representatives to claim tariff damages separately from non-tariff PSLA and also to claim the exceptional circumstances uplift of up to 20% where appropriate; and

4) Corresponding fields in the compensator response to the Stage 2 Settlement Pack for tariff damages and uplift.

We are aware that users are making their own preparations in readiness for the launch of the Official Injury Claims Service.  In order to limit the development users will be required to make to the Claims Portal, we will only implement the essential changes to meet the end of May deadline.  We recommend that you pass this information onto your IT department and/or software supplier.

Please note that further changes may follow later this year.
