B1. Introduction

The response to a Claim Notification Form (CNF) depends on the claim type, and who sent the claim.

B1.1 Claim Types

For EL/PL claims, the claim types are:

  • Employers’ Liability (Accident)
  • Employers’ Liability (Disease)
  • Public Liability

For RTA, there is only the one Claim type: 

  • RTA

B1.2 Responding to claims

The steps for responding to an RTA claim.

Review the claim and decide whether to:

  • Accept the claim
  • Reject the claim
  • Reassign the claim

If you Accept the claim, you need to:

  • Apply/Not apply Article 75 (not applicable for MIB claims)
  • Make the Liability decision

 

The steps for responding to an EL/PL claim.

  • Acknowledge the claim.

Review the claim and decide whether to:

  • Accept the claim
  • Reject the claim
  • Reassign the claim

If you Accept the claim, you need to: 

  • Make the Liability decision

B1.3 Identifying who sent a claim

Almost all claims processed through the Claims Portal are submitted by Claimant Representatives on behalf of a claimant. On rare occasions a claim may be submitted by a litigant in person (LIP), an individual who is representing themself.

You can identify when a claim is submitted by a LIP on the CNF by the 'Tick here if you are not legally represented?' check box at the top of the first page.

 

Section N of the CNF, the Statement of truth, will indicate that the CNF has been sent from the Claimant, rather than from the Claimant's legal representative.
